By engaging in a charter or using our Service, you are agreeing to these Terms. If you do not accept any part of these terms, you are prohibited from using the Service.

2. Service Overview

MiddleGroundHub offers luxury yacht charter services, including, but not limited to:

  • Day trips on a yacht
  • Evening cruises
  • Business getaways
  • Exclusive parties
  • Extended sailing excursions

All offerings are subject to availability and prevailing weather conditions. We maintain the right to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

When reserving a charter, you must:

  • Be a minimum of 18 years old
  • Provide valid and complete information
  • Pay the necessary deposit as outlined in your reservation confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

Confirmation of your booking is provided after the payment is received and we send you a written confirmation. We retain the discretion to decline service to any person.

3.3 Availability

All booking options are contingent on the yacht's availability and appropriate weather conditions. We will attempt to accommodate your requested dates and hours to the best of our ability.

4. Payment Terms

4.1 Pricing

Pricing is quoted in € and is inclusive of all applicable taxes unless stated otherwise. Prices are subject to alterations without prior notice.

4.2 Payment Schedule

  • Initial payment: 50% of the complete charter fee is due at the time of reservation
  • Final payment: Owing 48 hours prior to the charter commencement
  • Supplementary fees (if any): Payable at the end of the charter

4.3 Payment Methods

We accept most major credit cards, electronic transfers, and verified checks. All payments are processed through a secure and encrypted system.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • With more than 72 hours notice before departure: Complete refund minus transaction fees
  • Between 24 and 72 hours before departure: 50% reimbursement
  • Less than 24 hours before departure: No reimbursement available

5.2 Weather Cancellations

In the case that we deem weather conditions as unsafe, our captain will propose to:

  • Reschedule the charter to an alternative date at no extra cost
  • Issue a full refund if it's not possible to reschedule

5.3 Mechanical Issues

If there is a mechanical failure with the yacht designated for your trip, we will make an effort to offer a comparable alternative. If a suitable replacement is not available, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions provided by the crew
  • Use safety gear as needed
  • Disclose any health conditions that may impact their safety
  • Stay within designated zones on the boat

6.2 Prohibited Items

The following items are prohibited on the yacht:

  • Glass containers
  • Illegal substances
  • Firearms or any type of weapon
  • Excess refreshments (going beyond a moderate amount)
  • Animals (unless prior authorization is given)

6.3 Conduct

Guest behavior should remain courteous at all times. We reserve the right to terminate a trip prematurely and without any refund if the conduct of any passengers presents a safety threat or ruins the experience for others.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to the cost incurred for your booking. We are not accountable for:

  • Injuries caused by your own negligence
  • The loss or harm of personal belongings
  • Unintended, indirect, or punitive losses
  • Delays stemming from adverse weather or circumstances out of our control

7.2 Insurance Coverage

We sustain comprehensive marine indemnity that insures our fleet and operations. Customers are liable for obtaining their individual travel and personal insurance.

7.3 Assumption of Risk

By partaking in our charters, you recognize that there are inherent dangers associated with marine activities, and you accept responsibility for your personal safety and welfare.

8. Modifications and Itinerary Changes

We retain the right to change itineraries, paths, or schedules due to weather, safety concerns, or operational needs. We will strive to offer an equivalent experience whenever alterations are enacted.

9. Force Majeure

We are not to be held accountable for any holdups, cancellations, or changes stemming from forces beyond our control, which include but are not restricted to:

  • Severe meteorological conditions
  • Catastrophic events
  • Governmental decrees
  • Port disruptions
  • Techincal failures

10. Privacy and Data Protection

Your private information is managed as per our Privacy Policy. Utilizing our services implies your consent to the collection and use of your data in line with our Privacy Policy.

11. Intellectual Property

The contents of our website, such as text, visuals, trademarks, and images, are safeguarded by copyright and trademarks laws. Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited without our formal consent.

12. Governing Law

These Terms are enforced by the laws effective in Portugal. Legal disputes are to be resolved within courts situated in Cascais, Portugal.

13. Changes to Terms
